BELOW ARE SOME OF THE COMMON VIOLATIONS THAT DEBT COLLECTORS COMMIT
Debt collectors cannot do the following:
FALSE STATEMENTS: Debt collectors cannot falsely state:
- that they are attorney's or government representatives.
-that they work for a credit reporting company
-that you have or are committing a crime
-they cannot misrepresent the amount you owe
-that papers they send you are legal forms if they are not
-that papers they send you are not legal forms if they in fact are legal forms
-fail to report on your credit report that a debt is disputed, if you have disputed the debt
HARASSMENT: Collectors may not harass, abuse, or oppress you or any third party by
-Publishing the names of debtors
-use obscene or profane language
-repeatedly call you or someone to annoy them
-use threats of violence or harm
-call you at work when they know it is inconvenient or that you cannot receive calls
-call you after receiving written notice from you that you want them to stop calling you
UNFAIR PRACTICES: Collectors cannot commit unfair practices such as:
-Depositing a post dated check early
-contacting you by post card
-threaten to take or actually take your property unless done so legally
-Collect more money like fees and costs that are not allowed by the contract or State law
UNETHICAL PRACTICES: Collectors cannot
-Bring a lawsuit in a court other than where the contract was signed or where you live
-Contact third parties looking for you more than once
-tell third parties that you owe a debt
